1. Who we are
PawanKrishna Solutions OPC Private Limited (“we”, “us”, “our”), operating as DevOrbital, is a private limited company registered in Kolkata, West Bengal, India. We operate the website at https://www.devorbital.com and provide digital product, AI, strategy, creative, and infrastructure services to clients globally.
2. Information we collect
- • Contact form data: name, email, country, phone or messenger handle, company, project description, budget, timeline, and any message you choose to send.
- • Engagement data: if we work together, any information you share with us in the course of the engagement.
- • Analytics: aggregated, anonymised page-view data via privacy-respecting analytics. We do not use third-party advertising cookies.
3. How we use it
- • To respond to your enquiry and propose suitable services.
- • To deliver work you've engaged us for and to communicate about ongoing projects.
- • To improve our website and service offering (aggregated analytics only).
- • To comply with legal obligations (e.g. tax/accounting records).
We do not sell your data. We do not use it for ad targeting. We do not share it with third parties except the processors listed below.
4. Third-party processors
- • Google (Sheets, Workspace): contact form submissions are stored in a Google Sheet and notification emails are sent via Google services.
- • Resend: sends the confirmation email after you submit the contact form.
- • Vercel: hosts the website and runs the contact API.
- • Calendly: if you book a strategy call, Calendly processes the scheduling.
- • Razorpay: if you make a payment to us, Razorpay processes the transaction. We do not store full card details.
5. Data retention
Inactive leads (no engagement, no follow-up activity for 24 months) are deleted from our systems. Records relating to active or past clients are kept for the duration of the engagement and for up to seven years after, to satisfy tax/audit requirements.
6. Your rights
You can request access, correction, or deletion of your personal data at any time. Email admin@devorbital.com. We respond within 30 days. If you are in the EU/UK, you have rights under GDPR. If you are in India, you have rights under the Digital Personal Data Protection Act 2023.
7. Cookies
We use only essential cookies (for security and the contact form) and anonymous analytics cookies. We do not use advertising or tracking cookies.
8. Children
Our services are not directed at people under 18. We do not knowingly collect data from minors.
9. Changes to this policy
We may update this policy from time to time. Material changes will be reflected in the “effective” date above. Continued use of the site after a change indicates acceptance.

Terms & Conditions

1. Acceptance
By accessing this website, contacting us, or engaging us for services, you accept these Terms & Conditions and our Privacy Policy.
2. Services
DevOrbital provides digital services across five pillars: Product Development, AI & Modern Builds, Strategy & Scale, Creative & Growth, and Infrastructure & IT. We offer no physical products; engagements are scoped on a per-project basis.
3. Engagement model
Every engagement begins with a written proposal and a Statement of Work (SOW) signed by both parties. The SOW governs the deliverables, milestones, payment schedule, and timeline for that engagement. These Terms apply in addition to the SOW; in case of conflict, the SOW prevails for the specific engagement.
4. Intellectual property
Subject to full payment of all amounts due under an SOW, ownership of the bespoke work product (source code, designs, copy, brand assets) transfers to the client at the conclusion of the engagement. We retain ownership of pre-existing tools, frameworks, and internal know-how used to deliver the work, which we grant the client a perpetual license to use as part of the deliverable.
5. Confidentiality
We treat all client information as confidential by default. We are happy to sign a mutual NDA on request. We do not publicly disclose client names or work without written permission and respect any NDAs in place.
6. Warranties & disclaimers
We warrant that work delivered under an SOW will meet the specifications in that SOW. Outside the SOW, services are provided “as is” without warranties of any kind. Website content (this page included) is for general information; we make no warranties about its completeness or fitness for any particular purpose.
7. Limitation of liability
Our total liability to a client under any engagement is capped at the fees paid by that client to us in the six (6) months immediately preceding the event giving rise to the liability. We are not liable for indirect, incidental, consequential, or punitive damages.
8. Indemnification
You agree to indemnify and hold us harmless against any claims arising from (a) content or materials you provide to us, (b) your misuse of deliverables after handover, or (c) your breach of these Terms or the SOW.
9. Termination
Either party may terminate an engagement with 30 days written notice. Either party may terminate immediately for material breach not cured within 14 days of written notice. On termination, the client pays for work completed to that point; we hand over all deliverables produced under the engagement.
10. Governing law & jurisdiction
These Terms are governed by the laws of India. Disputes will first be resolved by good-faith negotiation between the parties. Failing that, disputes will be referred to arbitration in Kolkata, India under the Arbitration and Conciliation Act, 1996. Indian courts at Kolkata have exclusive jurisdiction.
Refund & Cancellation Policy

1. We sell services, not products
DevOrbital is a digital services provider. All engagements are scoped via a signed Statement of Work (SOW). Refund and cancellation rules below apply to those engagements.
2. Strategy calls
Initial strategy calls booked through our Calendly link are free of charge and can be cancelled or rescheduled at any time before the call via Calendly.
3. Project cancellation
Project engagements can be cancelled by either party with 30 days written notice. Cancellations are handled case-by-case via direct discussion. Any unutilised portion of a paid milestone is refundable on a pro-rata basis within 14 business days of the cancellation date, less actual costs incurred up to that point.
4. Completed milestones
Once a milestone is delivered and accepted (or 7 business days have passed without feedback after handover), the fees for that milestone are non-refundable.
5. Retainer / subscription cancellation
Monthly retainer or subscription engagements require 30 days written notice for cancellation. Fees for the notice period are not refundable.
6. Refund mechanism
Approved refunds are processed back to the original payment method via the same gateway used for the original payment (e.g. Razorpay). Bank/gateway settlement timelines apply (typically 5–10 business days).
7. How to request
Email admin@devorbital.com with the engagement reference and details. We confirm receipt within 2 business days and resolve within 14 business days.
Shipping Policy

1. Digital delivery
DevOrbital is a digital services provider. Under standard engagements, no physical goods are shipped. All deliverables — source code, designs, documentation, accounts and credentials — are handed over digitally via shared repositories, email, or cloud storage as agreed in the SOW.
2. Delivery timelines
Digital deliverables are handed over according to the milestone schedule defined in the SOW. We notify the client by email within one business day of each delivery.
3. Physical hardware (edge case)
In rare cases an engagement may include procurement and delivery of physical hardware (e.g. development boards, devices for testing). Such items are billed and shipped separately under a one-off agreement; shipping fees, timelines, and courier are specified in that agreement. We do not stock or sell physical inventory directly through this website.
4. Issues with delivery
If you do not receive a scheduled digital deliverable or notice an issue with hardware shipped to you, email admin@devorbital.com within 7 days and we'll resolve it.
